In order to give effect to employment rights contained in section 23 of the Constitution, a new Labour dispensation came into being post 1994. Although there are a number of other pieces of labour legislation which occupy varying positions of importance and relevance in order to achieve the right to fair labour practices, as now protected by the Constitution, the Labour Relations Act number 66 of 1995 (the Act) forms the cornerstone of our statutory labour laws. The Act is supported by various other pieces of legislation such as the Basic Conditions of Employment Act 75 of 1997, the Employment Equity Act 55 of 1998, the Skills Development Act 97 of 1998, Compensation for Occupational Injuries and Diseases Act of 1993 (COIDA), the Employment Services Act 4 of 1994 and various others.
